“The Nature of Crime.” Please respond to the following: To reflect on . . . There’s no way to rule innocent men. The only power any government has is the power to crack down on criminals. Well, when there aren’t enough criminals, one makes them. One declares so many things to be a crime that it becomes impossible for men to live without breaking laws.” ~ Ayn Rand “We do not condemn it because it is a crime, but it is a crime because we condemn it.” ~ Émile Durkheim Hello and welcome to Week 1! This week, as we reflect on what is the nature of crime, consider – how does a crime become a crime? Who decides? How do new crimes get created? And when culture and society change, how and when does a crime stop being a crime? As an example: Think about new crimes that exist today that our founding fathers never dreamed of, and then consider crimes that were crimes back then (like having an ice cream soda, or shopping, on Sunday) – but are no longer – or crimes that are on the books today, but maybe should be removed. For example, think of some things that are illegal today that were not 100 years ago – like being able to purchase over-the-counter morphine. Or 13-year-old girls being able to get married without parental consent. On the other side, has anyone heard of people being prosecuted for committing adultery recently? (Other than in the military. Wink ) It happened in NY just a few years ago in 2010: Woman Charged With Adultery to Challenge New York Law https://abcnews.go.com/TheLaw/woman-charged-adultery-challenge-york-law/story?id=10857437 And then there are laws that perhaps go to far – at least 13 states require sex offender registration for public urination, according to Human Rights Watch’s comprehensive review of sex offender laws in 2007. So here is your challenge this week (this is what your post should be about): think about the key differences between criminal law and moral law, and how laws have changed over the last 200 or so years in the US. From the e-Activities: the Supplemental Resources, or other on-line research, here is where your research comes into play – provide one (1) specific example where the criminal law system legislated (or is legislating) conduct or morality. Discuss how or why that law was passed or is being considered for passage. In your reply responses to another student, consider Durkheim’s words, “We do not condemn it because it is a crime, but it is a crime because we condemn it.” Regarding the law your fellow student has presented, was it necessary or good for society at that point in time that the law was passed? Was it ever overturned? If not, should it be? Note: an exemplary score will include an original post of at least 150 words, with a well-written response to one or more other students. Full citations are not required in the discussions – the case name, book title or website link is sufficient.

Hint Water began 15 years ago when founder Kara Goldin decided to make changes to her lifestyle. The mother of three (now mother of four) had recently left her high-profile job as vice president of shopping and e-commerce partnerships at AOL, where she had built revenue to more than $1 billion in less than seven years. Then she took time off to plot her next move. She expected her path to veer towards work with nonprofits, but instead her path veered into the beverage industry. Noticing low energy levels and skin issues, she began to suspect her reliance on “diet” beverages that were packed with added sugars and artificial sweeteners. However, when she tried to drink only water, she struggled with the taste. This realization led to the creation of Hint. Today, Hint is the largest non-alcoholic beverage company in the United States that isn’t affiliated with Coca-Cola, Pepsi, or Dr. Pepper Snapple. Since starting Hint Water in her basement in 2004, and running the business from her dining room table and out of her garage, her offering, which contains no sugar, no preservatives, and no calories, has become a leader in an emerging category known as natural essence waters. While Goldin and husband, Theo, a former attorney at Netscape and Hint’s COO, originally targeted natural and specialty stores, the product is proving to have wider appeal. Today, the waters, flavored with extracts of watermelon, raspberry-lime, and more exotic blends like pomegranate-tangerine, are among the fastest growing of the flavored waters at Whole Foods and sold at mainstream markets, including Publix, CVS, Food Emporium, Stop & Shop, Sheetz convenience stores, and online sites like Amazon.com. Hint has made cameos on Grey’s Anatomy, Boston Legal, and CSI and is the “official flavored water” on the Google campus. Goldin states that “there are more than 2,000 beverage companies in the United States today, but it’s hard to name a beverage company that’s actually about health. There’s a lot of healthy perception versus healthy reality. We’re really focused on changing health; we’re actually, like I said, hearing from lots of consumers that we’re doing it.” Hint has recently launched into new areas, including a sunscreen. Goldin says, “We’re launching sunscreen to call attention to chemicals like oxybenzone and parabens, which are in 95 percent of the sunscreens available to the average consumer in drugstores like CVS and Walgreens and elsewhere. I’m really, really excited. It speaks to the mission of the overall company, which is [to be] a consumer advocate and help people actually understand products. In doing so, we also offer products for sale that really help people get as healthy as they want to be.” Hint has also added new products in the categories of deodorant, hand sanitizer, masks, and more. Questions: 1) Evaluate the quality of the new brand extensions using the criteria in the chapter. Would you have advised going into all of these markets? If you wouldn’t have, which ones would you have advised not entering? Be sure to provide your rationale. 2) Into what other product categories do you think Hint should expand next? Provide your rationale. Make sure to do your research here (i.e., don’t choose categories that Hint has already expanded into or has publicly announced they are expanding into).

As you read in the articles for Chapter 11, several brands are replacing their brand mascots. In 2021, the well-known Aunt Jemima brand transitioned into Pearl Milling Company. Do you think the new name was well-chosen? Why or why not (be sure to use chapter concepts)? Using the concepts in the chapter, what recommendations do you have to make this transition a successful one? Finally, identify one brand mascot (not named in the articles) that you feel is due for replacement; be sure to state why and any recommendations you have for a new one.

CASE STUDY: Preschool Child: Ricky Ricky, age 4 years, arrives in the clinic with his mother. Ricky lives with his mother and father, who both work full-time, and his infant sister. Their extended family lives in a different state more than 100 miles away. Both parents are of average height and in good health. Ricky’s mother mentions that Ricky often expresses frustration, particularly in regard to food. Conflict over food occurs every day. Mealtime is a battle to get him to eat, unless his mother feeds him. Ricky’s baby sister seems to tolerate all baby foods but requires her mother to spoon-feed. Ricky’s mother is quite frustrated and concerned that he will become malnourished. Reflective Questions 1. What additional assessment information would you collect? 2. What questions would you ask, and how would you further explore this issue with the mother? 3. In what ways does the distance of the extended family influence this family’s approach to health promotion? 4. What factors would you consider to determine whether malnourishment is a factor in this family 5. 2 pages plus 1 page reference, free plagiarism
